Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of software and applications provided by Tivio IT ("we", "us", or "our"), including our apps listed on the monday.com marketplace such as "Subitem rollups & summaries". Tivio IT is operated by Timi Vovk s.p., based in Slovenia.

2. Use of the App

By installing or using our apps, you agree to these Terms. You must use our apps in compliance with all applicable laws and monday.com's own Terms of Service. You agree not to misuse our services or help anyone else do so.

3. Account and Access

Access to our apps is managed via your monday.com account. You are responsible for maintaining the security of your monday.com account. Administrators on your monday.com account have the authority to install, uninstall, and configure our apps.

4. Intellectual Property

The app, including its code, documentation, and design, is owned by Tivio IT and is protected by copyright and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the app for your internal business purposes.

5. Subscriptions, Pricing and Billing

Subscriptions, billing, and payments are handled entirely by the monday.com marketplace. Plan details, pricing, and trial periods are displayed on the app's marketplace listing. We do not store your payment information.

6. Data and Privacy

We respect your data. Our apps process data from your monday.com account only as needed to provide the requested features (e.g., performing rollups). For full details on how we handle data, please refer to our Privacy Policy.

7. Service Changes and Availability

We may update, modify, or discontinue features of the app to improve it. While we strive for high availability, the app is provided on a reasonable effort basis and we do not guarantee 100% uptime.

8. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

To the maximum extent permitted by law, Tivio IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify and hold harmless Tivio IT and its operators from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the app or violation of these Terms.

11. Termination

We may suspend or terminate your access to the app if you violate these Terms. Upon termination, your right to use the app will immediately cease. You may discontinue use of the app at any time by uninstalling it.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law provisions. Any disputes shall be resolved in the competent courts of Slovenia.

13. Changes to These Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the app after changes become effective, you agree to be bound by the revised Terms.
